Any entries received after 11:59pm on September 28, 2009 will automatically be entered into our next contest.
-Once you have uploaded your video, be sure to tell your friends and family to come view your video, winner will be chosen from the top 5 videos with the highest views. Make sure to tell all your friends and family to come and view your videos and pictures.
-Winner will be announced on the website on September 30th at 8pm EST

Overview
Are You Kidding, Inc. is happy to feature your videos and pictures, and reward those who bring the most entertainment to the online community. Through constant web updates, and other forms of online communication, contest dates will be posted at www.areyoukidding.net. All who wish to participate in any said contest must submit their video(s)/ picture (s) no later than the given contest deadline. This deadline has been determined to give each entry fair, and ample time to be viewed.
Winner(s) will be decided not by the Executive Management or staff of Are You Kidding, Inc., but first, by those who visit, view, and review your videos. Then a panel of judges from our sponsors will select the grand prize winner. Prizes will be sent to any winning entrant with personal information delegated to, and only to, Are You Kidding, Inc. upon submission of your video/picture.
Official Rules
Current contest period: begins at 12:00:01 a.m. Eastern Standard Time ("EST") on July 1, 2009 and ends at 11:59:59 a.m. EST on September 28, 2009 (the "Contest Period").
There will be ten finalists, five of which will be chosen by those who visit, view, and review your videos. The last five will be decided by the Executive Management or staff of Are You Kidding, Inc. The winner will be carefully determined by a panel of judges consisting of our current sponsor(s). Prizes will be sent to any winning entrant with personal information delegated to, and only to, Are You Kidding, Inc. upon submission of your video/picture.
How to enter
To enter the Contest, during the Contest Period visit www.areyoukidding.net (the "Contest Website") click on the corresponding video or picture link and complete all required registration information and upload a video (between 5 and 120 seconds) or a picture in one or more of the available categories. You may submit as many videos/pictures into each category. The person uploading the Entry will be deemed the entrant (the "Entrant"). After you have submitted a video/picture, you may remove your video/picture from the Contest (and your entry will not be eligible) by 11:59:59 p.m. EST four (4) weeks prior to the deadline for the last entry to be received. By entering, you understand that your entry will (in Are You Kidding, Inc.'s sole discretion) be posted online for consumers to view and vote on. In the event of a dispute as to the identity of an Entrant, the Entrant will be deemed the name appearing on the Entry. All Entries must be completed and submitted by 11:59:59 a.m. EST by each Entry Period's deadline (as indicated in the chart below), to be eligible for that Entry Period's judging and all subsequent Entry Periods' judging’s, if any. Normal Internet access and usage charges imposed by Entrants' online service will apply. You will also allow the Are You Kidding Staff to post the winners on our social networking pages, i.e. Facebook, Twitter, TV interviews, etc.

Entry Requirements
In order to be entered into the Contest, Entrants must comply with registration instructions when submitting their video/picture. The video must be in one of the following formats: .avi, .mov, .mpg, .mpeg, .wmv, .qt, .mp4, .flv, .ram, .ogm, .mpeg4, .mp4v, .mpe, .mkv. The Entry may not contain obscene, lewd or inappropriate images or text including no acts of violence, nudity, or acts that appear to cause harm, as determined in Are You Kidding Inc.'s sole discretion. Any Entry Material or portion thereof that is, in the Are You Kidding Inc.'s sole discretion, obscene, profane, lewd, defamatory, contains any third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the Entrant. Entrants may not copy or otherwise plagiarize the Entry Material from any source. Are You Kidding, Inc. has the sole discretion to determine whether a video qualifies as an Entry. All Entries must be the sole, original work of the Entrants. Entries become the property of Are You Kidding, Inc. and will not be acknowledged. Entrants and winners acknowledge and agree that their Entries become the property of Are You Kidding, Inc., which thereby has the right to edit, adapt, modify, reproduce, promote and otherwise use Entries in any way it sees fit (please refer to our terms of use). Any Entry not in compliance with the above and does not meet the Websites' requirements will be disqualified. By entering, you agree to waive any rights you may have to the Entry submitted.
Eligibility
-Open to legal residents of the 50 United States and the
-Employees of Are You Kidding, Inc are not eligible to participate or win.
-All federal, state and local taxes are the sole responsibility of winner (or the parent/guardian if winner is a minor in his/her state of residence).
-All eligible videos must be between 5 seconds and 120 seconds (2 minutes), and be appropriate for all ages.
-The staff at Are You Kidding, Inc. holds the right to refuse entry to videos/pictures that obstruct the standards and practices of family oriented entertainment.
-Videos/pictures that include: Violence, sexuality, drug/alcohol use, abuse, profanity, pornography, etc. listed are, but not limited to, causes to deny entry onto website as well as contest participation.
-To be considered eligible, all videos are to be submitted by the given contest deadline. Any videos/pictures submitted after said date will have the opportunity to participate in the following contest.
Voting/Viewing
All eligible entries are posted for open voting and viewing by Are You Kidding, Inc. members. Videos/pictures that make it to the top five most viewed entries will be in turn subjected to a panel of judges which will decide the winner of the contest.
Releases
All entrants automatically give Are You Kidding, Inc. irrevocable, nonexclusive and unrestricted license to use the video permission to produce and reproduce footage from everyone involved, heard, depicted, and seen on your videos (please see our terms of use).
Judging
All eligible Entries submitted by the Entry Period Deadlines (as indicated in the chart above), will be subject to open voting and viewing by members of the Are You Kidding, Inc. community. The top five rated videos will then be presented to a panel of judges who will rate videos/pictures on the corresponding Judging Date, based on the following criteria: Originality and Creativity (30%); Funny content (30%); and Overall Appeal (40%). Are You Kidding, Inc. will then combine their judging score. In the event of a tie after the Entrants' tied Entries will be re-judged by the judges based solely on how funny they are. The Finalist with the top overall score will be determined the Grand Prize winner. Judges' decisions are final with respect to all matters relating to the Contest. By participating, Entrants agree to the Official Rules and the decisions of the Judges, which shall be final and binding in all respects.
Grand Prize and Approximate Retail Value ("ARV")

Prize is awarded "as is" with no warranty or guarantee, either express or implied by Are You Kidding, Inc. Prize is not transferable. No substitution or transfer of prize permitted except at the sole discretion of Are You Kidding, Inc. who reserves the right to substitute a prize (or portion of prize) of equal or greater value in the event the prize is unavailable. Taxes related to the prize are the responsibility of the Grand Prize Winner. All other expenses and costs not expressly listed above are the Grand Prize Winners' sole responsibility

(1) The picture contest: The prize details entails a membership to Nannies4hire.com with a retail value of $299. This will give the winner 99 days to access the Nannies4hire.com database and also receive 1 multi state criminal history search, 1 multi state sex offender, 1 driving record and 1 social security number trace. nannies4hire will also sponsor a nanny in the family's home for 8 hours. (Nannies4hire.com will be paying the nanny for those 8 hours) NANNIES4HIRE.COM brand will be awarded and the Grand Prize Winner will be notified by phone, mail and/or e-mail. General Rules
Are You Kidding, Inc. will make three (3) attempts to contact the potential Grand Prize Winner via phone within 24 hours from the time winner determination was accomplished. If Are You Kidding, Inc. is unable to reach the potential Grand Prize Winner via phone within this time frame, he/she will be disqualified and an alternate will be determined. Potential Grand Prize Winner (or parent/legal guardian if a winner is a minor in his/her state of residence) will then be required to sign and return an Affidavit of Eligibility, liability/publicity release (except where prohibited by law) within three (3) days (including weekends) of notification attempt or the prize will be forfeited and alternate winner may be determined. Affidavit package will be mailed via overnight mail with an overnight return envelope included or sent via email. Return of prize notification as undeliverable may result in disqualification and alternate determination. As a condition of Entry into the Contest, grand prize winner agrees to release Are You Kidding, Inc. and its Administrators, each of their respective agencies, parents, subsidiaries, affiliated companies and each of their respective officers, directors, shareholders, members, employees, agents, assigns, and all others associated with the development and execution of this Contest (collectively the "Released Parties") from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting an Entry or otherwise participating in any aspect of the Contest, the receipt, ownership or use of prize awarded or any typographical or other error in these Official Rules or the announcement of offering of the prize. Acceptance of prize constitutes permission to use Grand Prize Winner's name, likeness and Entry/video for promotional purposes (including any possible public relations opportunities) without further compensation except where prohibited by law. By entering, Entrant accepts and agrees to be bound by these Official Rules. Entries will be declared to be made by the authorized account holder of the e-mail address submitted at the time of Entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, Online Service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Are You Kidding, Inc. reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the Entry process or the operation of the Contest or the Website; violates the Official Rules; acts in an unsportsmanlike or disruptive manner; or acts with intent to annoy, abuse, threaten or harass any other person. The Released Parties are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender, by any of the equipment or programming associated with or utilized in this Contest which may limit the ability to participate, or by any human error which may occur in the processing of the Entries in this Contest. Entries generated by script or bought are not eligible. Are You Kidding, Inc. reserves the right to cancel, terminate or modify the Contest if it cannot be completed as planned for any reason, including but not limited to for infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or corruption of any sort. In such event, Are You Kidding, Inc. will award prizes from eligible Entries received prior to cancellation. As a condition of entering the Contest, Entrant (or parent/legal guardian if Entrant is a minor in is/her state of residence) agrees that: 1) under no circumstance will Entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event attorneys fees.
Conditions
Winner acknowledges and agrees that his/her Entry becomes the property of the Are You Kidding, Inc. (please see our terms of use), which thereby has the right to edit, adapt, modify, reproduce, promote and otherwise use Entries in any way it sees fit in connection with advertising or promoting the Are You Kidding, Inc. brand and products in any medium, throughout the world, in perpetuity. Entrant shall have no right to review or approve edits, alterations or modifications, and the Entrant waives the benefit of any provision of law known as "moral rights". No information regarding Entries or judging will be disclosed to any third party not involved in the conduct of the Contest. By submitting an Entry, you represent: (a) that the Entry is your own original work that has not previously been published or publicly shown or won a prize or award; and (b) any and all rights to the Entry belong to you and the Entry does not infringe, misappropriate or violate the rights of any third party. Further, any Entries that Are You Kidding, Inc. in its sole discretion, deems to be inappropriate for publication will not be considered.
